NCC threatens to sanction unauthorised users of its 5.4GHz frequency band

The Nigerian Communications Commission (NCC) in a stern notice has cautioned unauthorised users against infringing on its 5.4 GHz frequency band, spanning the 5.430–5.725 GHz range without a valid licence, with the threat of severe sanctions for non-compliance.

In a public notice signed by the NCC Director of Public Affairs, Reuben Mouka, the Commission highlighted that unauthorised users have a 14-day window to cease operations and refrain from transmitting signals or utilising equipment within this band without proper authorization from the NCC.

The NCC hinted that the 5.4 GHz frequency band is a licenced spectrum in Nigeria, and any transmission or equipment usage without the requisite frequency licence is deemed illegal.

The warning, according to the notice, extends to all telecommunications service providers, public or private organisations, and individuals across the country.

Citing Section 122 of the Nigerian Communications Act (NCA), 2003, the NCC underscored the criminal nature of operating at a frequency not duly assigned by the Commission. The potential consequences outlined include imprisonment, sanctions, and the confiscation of equipment utilised for illegal services.

It stated that after the expiration of the 14-day enforcement notice, the NCC asserts its intention to initiate appropriate enforcement actions, including but not limited to prosecution, fines, and confiscation of equipment involved in the unauthorised transmission of services.

The NCC also emphasizes the availability of detailed regulatory provisions for the deployment of services on the entire 5GHz band in the Guidelines for Deployment of Broadband Services on the 5.2–5.9GHz band.
